What Does the Medical Board Prosecute?
The Medical Board prosecutes through the Accusation process the following professionals:
Medical Doctors
Licensed Midwives
Polysomnographic Trainees, Technicians, and Technologists
The board investigates podiatrists, but the Accusation filing and prosecution are handled by the Podiatric Medical Board of California.
Distinction Between MDs and DOs
Despite the public generally viewing MDs and DOs identically, and despite their full equality in terms of scope of practice, the American Association of Colleges of Osteopathic Medicine (AACOM) states that “Osteopathic medicine is a distinctive form of medical practice in the United States.” This distinction is recognized by the fact that the Medical Board does not investigate or prosecute Osteopathic Physicians. There is a separate, independent board called the Osteopathic Medical Board of California.
Oversight by the California Department of Consumer Affairs
All of these boards answer to the California Department of Consumer Affairs, and all board members are appointed by the Governor.
